ADVERTISING TERMS AND CONDITIONS
  1. All advertisements are subject to JAHAJEE.com standard terms of service
  2. DEFINITIONS
    • "Advertiser" means the person whose goods or services are advertised;
    • "Advertisement" means display, recruitment, online, email, mail order and classified advertising and shall include inserts, supplements and re-directed advertisements;
    • "Buyer" , "You" means the person placing the order for the insertion of the Advertisement;
    • "Agreement" means
      (i) these Terms,
      (ii) any document which references these Terms
      (iii) the Policies;
    • "Creatives" means all ad content, related technology and tags which are subject to the Policies;
    • "Display Ads" means any and all graphical ads (in .gif, .jpeg, .jpg or such other formats as JAHAJEE.com may notify you from time to time);
    • "End Date" means the date (if any) on which the parties agree this Agreement will terminate and all types of ads will cease to be made available;
    • "IC" means ad impression count;
    • "Policies" means the Advertising policies located at: http://www.jahajee.com/j/advertising-terms/?page=policy or such other URL as made available to You from time to time;
    • "Terms" means these advertising terms and conditions.
  3. These Terms apply to advertisements in the www.jahajee.com and by placing an order, the Advertiser accepts and agrees to be bound by these Terms in full. Any other conditions proposed by the advertiser shall be void.
  4. JAHAJEE.com may, without any responsibility to the Advertiser, reject, cancel or require any Advertisement to be amended that it considers unsuitable or contrary to these Terms and remove, suspend or change the position of any such Advertisement. JAHAJEE.com may refuse to publish any Advertisement for any Advertiser who has not paid any sums due for any advertising. The Advertiser will remain responsible for all outstanding charges.
  5. The publication of an Advertisement by JAHAJEE.com does not mean that JAHAJEE.com accepts the Advertisement has been provided in accordance with these Terms or that JAHAJEE.com has waived its rights under these Terms.
  6. The Advertiser guarantees to JAHAJEE.com to comply with the advertising policy at all times.
  7. The buyer guarantees that he/she is authorised by the advertiser of a product or service to place the Advertisement with JAHAJEE.com and the buyer will compensate JAHAJEE.com for any claim made by such advertiser against JAHAJEE.com.
  8. Approval Process
    • All advertisement go through an approval process to make sure they are safe and appropriate for viewers.
    • We review each ad to see if it complies with our advertising policies. If we find any issues, we will let you know more about the policy and what you can do to get your ad running.
    • We work hard to review advertisements as quickly as possible, and we review most ads within 2 business day. Some reviews may take longer because some ads require more complex review.
    • If we find anything that does not follow our policies, we will mark your advertisement or keyword and send you an email/message with information about that policy.
  9. Payment
    • All new customers will be required to prepay
    • All Advertisements are accepted on the basis that they will be paid for at the applicable rates set on the date of publication. JAHAJEE.com may change its rates at any time by publishing the modified rates at www.jahajee.com/advertise/. Any changes to the rates will take effect immediately. However, any changes to the applicable rates will not apply to any orders made prior to the date of such change.
    • Prices published are subject to revision at any time and orders are accepted on the condition that the price binds JAHAJEE.com only in respect of the period specified in the applicable rate card.
  10. Online Advertisements
    • JAHAJEE.com shall use reasonable endeavours to place ads in accordance with the placement options made available and selected.
    • Buyer shall submit Creatives at the time of booking.
    • JAHAJEE.com cannot guarantee the number of impressions.
    • In the event of any disagreement regarding the number of impressions served, the Advertiser agrees that the figures provided by JAHAJEE.com, will be final and binding.
    • JAHAJEE.com shall use its reasonable endeavours to reproduce Advertisements as provided by the Advertiser but cannot guarantee that the Advertisement will be of the same quality.
    • JAHAJEE.com accepts no responsibility for any interruption or delay the Advertiser experiences in delivering any Advertisement copy to JAHAJEE.com or any loss or damage to any Advertisement copy or any other materials. The Advertiser guarantees that it has retained sufficient quality and quantity of all materials supplied to JAHAJEE.com.
    • JAHAJEE.com will not be responsible for any additions to, changes in, deletions from, delays in publication or withdrawal of any Advertisements required by any authority having responsibility for the regulation of online advertising.
    • If the Advertisement as reproduced by JAHAJEE.com contains a substantial error solely due to a mistake on JAHAJEE.com's part, JAHAJEE.com shall, on request, re-publish the Advertisement at no additional cost to the Advertiser. JAHAJEE.com shall not be responsible for repetition of errors and it is the Advertiser's responsibility to inform JAHAJEE.com of any errors and provide any necessary assistance to JAHAJEE.com to prevent a repeat of the error.
    • JAHAJEE.com shall not be responsible, under any circumstances, for any loss of profit, loss of opportunity, loss of goodwill, loss of anticipated saving, loss of revenue and/or any other loss which happens as a side effect of the main loss suffered by the Advertiser or any loss which could not be contemplated by JAHAJEE.com and the Advertiser, and JAHAJEE.com's maximum total liability for any loss or damage arising out of or in relation to any Advertisement whether in contract, tort or otherwise shall not exceed the total amount of the charges for the relevant Advertisement actually paid by or on behalf of the Advertiser.
  11. Refund Policy
    • This refund policy covers the circumstances under which JAHAJEE.com may in its discretion provide refunds.
    • JAHAJEE.com may amend its Refund Policy at any time by posting a revised Refund Policy on the Site. You are responsible for regularly reviewing the Site to obtain timely notice of such amendments. You shall be deemed to have accepted such amendments by continuing use of the Site or of your Account after such amendments have been posted or information about such amendments has been sent to you.
    • If a booked Advertisement is not published at all solely due to a mistake on JAHAJEE.com's part, JAHAJEE.com will try to offer an alternative advertising date(s). If the alternative date(s) is not accepted, the original booking will be cancelled and the Advertiser shall be entitled to a full refund. This shall be the Advertiser's sole remedy for failure to publish the advertisement.
    • Request for consideration for a refund can be send by email to advertise@jahajee.com with following details:
      # USER ID
      # AD LOCATION
      # DATE OF BOOKING
      # EMAIL ID OF ACCOUNT
      # REASON WHY YOU WOULD LIKE US TO CONSIDER REFUND.
    • JAHAJEE.com will consider granting refunds that are requested within 7 days of booking and that meet the applicable criteria, and will grant refunds at its reasonable discretion. Nothing herein grants an obligation by JAHAJEE.com to grant a refund.
  12. Content of Advertisements:
    • All content in advertisements through this Site, including without limitation data, text, images, sound, video and other information and materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the party from which such Content originated. You, therefore, are solely responsible for all Content that you submit to be placed as advertising or that you upload, post, display, email, transmit or otherwise make available through the Site.
    • JAHAJEE.com does not control the Content and does not guarantee the accuracy, integrity or quality of any Content.
    • Under no circumstances will JAHAJEE.com be liable in any way for any Content, including but not limited to any errors or omissions therein or any loss or damage of any kind incurred as a result of the use of any Content.
  13. Liability of the Advertiser
    The Advertiser will fully reimburse JAHAJEE.com for all claims, losses or expenses arising as a result of any breach or failure to perform of any of these Terms and/or the use or publication of the Advertisement by JAHAJEE.com in accordance with these Terms.
  14. Rights
    • JAHAJEE.com owns the copyright in all Advertisements written or designed by it or on its behalf.
    • The Advertiser grants JAHAJEE.com the right (free of charge) to:
      A) use such of the Advertiser's names, trade marks and/or logos as JAHAJEE.com may consider necessary for the purposes of publishing the Advertisements;
      B) reproduce the Advertisement in any media at any time for promotional purposes.
  15. Cancellation policy
    • The Advertiser may cancel an Advertisement provided that notice in writing is received by JAHAJEE.com within the relevant End date. Please send notice of your intention to advertise@jahajee.com . Cancellation will only be effective on confirmation of receipt of your notice.
    • If the Advertiser is insolvent or bankrupt or is otherwise in breach of these Terms, JAHAJEE.com may treat the order as cancelled.
