During multimodal transport part of cargo damaged during railwy transport. who will be liable and how much ?

Since the mode in which the damage occurred is known the MTO%u2019s liability will be as per the prevailing applicable relevant law governing at that time pertaining to that mode of transport. Hence the railways will be liable for any damage claims. If ad valorem freight is not applicable then the Railways will limit their liability at the rate of Rs 50/- per Kg   as per Railways Act 1989.
